since june. we are looking at a pullback this tuesday morning. dow industrials down 150 right now, nasdaq down 63, and s&p 500 lower by 19. markets on the move as they await key inflation data, the july cpi is out on thursday, the pp be i out on friday. congress remains on recess this week. oil prices, the big story in markets this morning, take a look. prices jumping to 10 week highs yesterday after saudi arabia extended production cuts for moanother month, setting off investor alarms over when a rescission might hit. crude oil sits at $81.71, down 1.5% this morning. european markets also in the red, take a look. we've got the european indices down across the board, italy announcing a surprise windfall tax, the ft 100 down 32, cac

quarante down 50. asia overnight markets finished mostly lower, hong kong was down about 1.8% overnight. that the biggest mover on the averages. the nikkei average in japan eeking out a gain. the hang sang down better than 1 and-a-half percent. the judge in president trump's mar-a-lago documents case asking special counsel jack smith to show his work on two filings and explain why a d.c. grand jury is working on a florida case. all of this as more is unraveling around the biden family as we learn hunter biden's former business partner, eric schwerin visited the obama white house more than previously known. hear what peter schweizer had to say about eric schwerin as gets set to testify in front of the

"mornings with maria" is live right now. ♪ maria: we've got more connections to report between joe biden and hunter's business deals. fox news digital revealing that eric schwerin who is hunter's long time business partner visited the obama white house and joe biden's vice presidential residence at least 36 times between 2009 and 2016. the president of the government accountability institute, peter schweizer, joined me on sunday morning futures on sunday saying schwerin was in control of the biden money. >> i would add the next shoe that may drop is there's another individual involved with hunter

biden named eric schwerin, he moved money around and based on the hunter biden laptop he had access not only to hunter biden's accounts but also joe biden's accounts. maria: joaning me is ten -- joining me now is t tennessee congressman tim burchett. we know that eric schwerin is going to be testifying in front of jim jordan's committee. what are your thoughts on what we're learning now about hunter biden's business affairs and how much joe biden was involved? >> i think first of all mr. schwerin's testimony is going to be imperative to what's going on, how he is controlling the biden family's money and the visits that he made of course to the naval obser observatory whis where the vice president lives. i've been in congress five years and i've been there one time. this guy was there at least 36

times. there's clearly some involvement there and the money trail never seems to end. they keep saying the next shoe is going to fall. this is an octopus. more shoes keep falling with this guy. i'm anxious to see jim jordan cross-examine him in testimony because it's going to be very interesting. maria: yeah. peter schweizer also told me that joe biden used a cell phone and that cell phone could unlock a lot of information. that's the number that the then vice president was using, joe biden, and he had to speak with hunter but hunter's business partners through that phone. here's peter schweizer on sunday. >> when you look at the billing on the p laptop, this cell phone that hunter biden -- sorry, that joe biden carried as vice president of the united states was actually paid for by rosemont, the archer, hunter biden business. and it's pretty clear this is the phone of contact when hunter

was with his business partners and was calling his dad or when one of the other business associates, eric schwerin is calling joe biden, he's using this phone number. we shared that phone number with the house oversight committee, congressman comer's committee. i don't know if they subpoenaed it yet but this could be the lock that -- sorry, the pick that unlocks everything. maria: congressman, what about that phone? do you have that phone? >> no, i do not. but as was stated, chairman comer of course is on top of it. the key to this whole thing is the fact that all this is all tied together and has influence in this white house currently. and you've got to ask yourself, when is this justice department going to take note of all of this illegal dealings. you have hunter biden who is obviously communicating with foreign embassies, foreign businesses, yet is not registered as a foreign agent. you and i would be -- they would

be breaking down our doors and put being us in hand a cuffs har something like this. once again there's a double standard with the biden crime family. maria: unbelievable. do you have a new read over how much money the biden family has taken in from foreigners. >> i stopped counting at around 20 million. at what point are they going to have to show they paid taxes on it. you and i sell $600 worth of stuff from ebay, we get a letter from the irs. there's no t evidence they paid any taxes on this stuff. the other media won't pay it any attention. it's collusion all the way around with this thing. maria: meanwhile, president trump's indictments are dominating the conversation on mainstream media. the former president's legal team now pushing back on special counsel jack smith, asking for a protective order to limit the president from publicly discussing the evidence in the january 6th criminal case.

the attorneys are arguing that only genuinely sensitive material should be blocked from the public view. trump posted this on social media. joe biden is behind this prosecution, he writes, well, he now wants thug prosecutor deranged jack smith to file for a court order, taking away my first amendment rights speech. congressman, what do you make of all of this? the former president has the next hearing on august 28th and we're expecting that a trial date will be announced. right in the middle of the campaign season, right? >> yes, ma'am. and president trump is correct. what you're seeing, maria, is jack smith is going to limit president trump's ability to rebut claims against him so all the other challengers, joe biden included, will make all these accusations and tie it to these cases and jack smith is making it illegal for president trump to talk about it. so it's a violation of first amendment. it's completely unconstitutional. and you have the fact that they're using the investigator,

out of washington, d.c., is now -- maria: special prosecutor. >> no, ma'am, well, the group that gets together -- maria: the grand jury in washington. >> yes, ma'am, the grand jury in washington is now investigating something in florida. so you have a -- it's just completely irrational and illegal, everything that's going on and then they're going to try this thing in washington dc where president trump received maybe 4% of the vote. i mean, give me a break. this thing is just -- it's just cooked up and it's already settled before the jury even meets so it's completely rid areic husband. maria: well, we're -- ridiculous. maria: well, we're following it all. we appreciate your leadership. we'll continue to stay with us. thank you, sir, congressman tim burchett joining us this morning. we have a miss on ups revenue, the stock is plummeting right

student loan bailout, the group accusing the administration of overstepping its power in canceling student loans for 800,000 borrowers, worth $39 billion. the education department only rolling out the plan after the supreme court struck down the broader student loan handout, calling is unconstitution. the new handout is estimated to cost taxpayers $475 billion over 10 years as a federal appeals court deals the biden administration another blow which is blocking new rules meant to make it easier for borrowers to have their debt relieved if they were defrauded by a university. greg, i don't understand how the administration is continuing to push this forward even after we heard from the supreme court, blocking this, saying that it is unconstitutional to forgive any student loan debt. now they want to cause americans to pay $475 billion to do just that. >> good morning, maria. well, that's exactly it.

we keep looking for ways to in many ways spend money and in this case it's not really direct spending but certainly forgiveness of loans is a form of stimulation. at the same time, if you listen to one of the biggest complaints around the country, it's inflation so measures like this from the supreme court's perspective i think is a very, very clear signal, the administration here trying to find other ways to go around the supreme court, the law of the land, and at the end of the day perception on this ultimately is that the administration is potentially looking to buy votes in this process. maria: yeah. and that's what happened i think right before the midterms. young people did believe that president biden was going to forgive their debt and they came out to vote accordingly, lee. >> it's interesting to look at public opinion here because just about half of americans actually do support student loan

forgiveness, 47%, that's bolstered by 85% of those who have student loans support this. 78% of democrats support this. only a third of independents do and 11% of republicans. so it's somewhat problematic. this is one of the president's signature plans. it's not supported by independents. and in many ways he hasn't sold it in a way that is appealing to the people he needs the most. similarly, he's got the same kind of problem with his stance on climate change, as much as he is saying the inflation reduction act is one of his huge victory, he's got 57% of americans who disapprove of his handling of climate change and they don't know -- 71% don't know what's going to happen as a result of all that so he hasn't sold to the american people what he's doing for them and these are two of the biggest things that he said are his victories and unfortunately it's not making the grade. maria: what scares me, lee, is that they're not recognizing the impact of more stimulus, i mean, greg just said it.

all of this is just more stimulus and it is stimulus that got us to 40 year highs in inflation. if you don't recognize this was the root of the problem, then how are you going to fix it? >> you know, i think you're getting at something that a lot of americans see. a lot of this is just putting lipstick on a pig. they're saying underneath it hair not addressing the root problem. we've got debt issues. i'm not talking about debt in the country, talking about individual debt, people are talking about taking on too much student loans, the cost is too expensive, not everyone should go to college. let's address the root of the problem,. maria: let's take a break. when we come back, markets reversing this morning after a big day yesterday on the buy side. we are kicking off the week with a mixed showing after the big rally yesterday. shares of ups this morning are down after missing on second quarter revenue and lowering the outlook. we're breaking down the earnings from ups.

maria: welcome back. let's take a look at futures this morning indicating a decline at the start of trading, dow industrials down 182, nasdaq down 74, s&p lower by 22. part of the letdown for the dow was ups and missing expectations on revenue but yesterday we had a great day on the markets, the dow jumped better than 400 points yesterday, s&p 500 and nasdaq snapped a four day losing streak following fitch's downgrading of u.s. credit last week. second quarter earnings season is in full swing. ups is crossing the tape this morning, beating on earnings per share, missing on revenue. the company lowered the annual revenue forecast on soft e-commerce demand and it said it reached a labor deal with the teamsters union for the 300,000 employees. eli lilly and fox corporation expected to report earnings later this morning, we'll have those numbers for you as well. joining me right now is mahoney

asset management ceo, ken mahoney. thank you for being here. ups is indicative of what's going on out there in terms of the demand story. how do you read the ups quarter? what does it mean for the broader markets do you think? >> for ups, i think some ofist is company specific. they're talking about the labor union and shutting down. a lot of companies said we're not going to wait, we're going to be proactive and went to fed ex or amazon or other carriers. you'll see that this quarter for ups, they missed a lot of their customers, had to go in another direction. the overall economy, i imagine higher gas prices, fuel prices is the theme now, last few weeks, oil is up six weeks in a row. it's not going to benefit fed ex, ups or any of the carriers. i think there's headwinds there of. for fed ex, it's concern about customers going elsewhere, not wanting to get caught up with the labor union strike which has gotten resolved.

maria: it's a great point. the big story of the week will be inflation data. we're looking ahead to the july cpi number out on thursday and july ppi number out on friday, ken. you mentioned oil prices. that's the underlying issue here. oil is back up to $80 a barrel. what's the impact? >> here we are, i believe we're trading below 7 $70 a barrel the was an opec put and they cut supply twice. the administration, strategic reserves at a level not seen since 1983 it's like shorting a stock and you have to cover it. they need to go back and replenish it. if you look at it, we have demand going up, six weeks in a row we've seen oil prices higher. there's a $70 a barrel put there. and the administration needs to buy some back and they're caught in a short trade at the moment. maria: so do you want to buy

oil stocks? oil prices are down this morning but they hit the highest level in months yesterday, ken. i mean, the wall street journal is writing that rising oil prices are bad news for drivers and the fed as benchmark crude is up 21% in just the last six weeks, ken. we've been seeing it creeping higher, higher, higher on oil arand i wonder what you do with that. do you buy oil stocks? do you pull back on stocks because you worry this is the underlying issue for inflation and it's still spiking? >> so growth managers usually find ourselves in energy, we're dipping our toe into it. we think the way to play is with specific stocks, buy the best stocks, and as far as going forward with the market, we've taken a little risk off position here. we're not bearish. we want to take some chips off the table. we had a blistering june and

july. here comes august limping in and we have a fitch downgrade, rates are higher but the biggest catalyst we believe for those that want to take shillings off the table is we saw the volatility index that was flat lined for most of the summer but had broke out of the range last week dramatically, is up again this morning. we're going to take some chips off the table. it's not a bearish view, i think long-term constructive and we think there's a correction. it's nice have powder dry, have money on the sideline, be opportunistic when and if the market comes through. maria: what's your timing on that? congress is o out of session rit now, not coming back until the week of september 12th. obviously donald trump and the biden influence peddling is dominating conversations right now. but what will be the focus for markets when everybody comes back in september, do you think? >> right. so we just ended the quarter. hopefully it was a decent

quarter. as i mentioned, there are headwinds that are creeping up. the fitch downgrade, we want to dismiss it, oh, it's fitch. it's telling congress you can't keep going like this, it's unsustainable. it's like going above the value of the house, that's where we are. a trillion dollars a year to service the dent. debt. they're not going to be talking about that. they'll be talking about everything but that. the things we spoke about about inflation falls on the administration, the nonstop spending. when they come back in session mid-september, there's a lot of positioning, so forth, nothing is going to get done in that and the market is not going to like the idea that message delivered but not heard and that's really what fitch sent down. maria: yeah. greg faranello, jump in here. because one issue in the markets are these higher yields, the 10 10year now sitting at 4% and staying there, ken. let me just bring in greg faranello. >> ken, good morning, it's good to be with you.

i mean, the repricing that we've seen of late is interesting because unlike the fed induced pricing that we've seen on the short end, 2021 into 2022 into 2023, has really been on the long end. it's been driven off the back of the fitch downgrade which in the grand scheme of things we don't think was a big deal and it was probably the excuse for rates to go higher and we've ratcheted back in. for ken, and i agree, taking some chips off the table with risk, sh short end yields are fantastic. what are clients saying about 5% t bills, yielding 5 to 6%, you can roll out of risk and still get yield. >> that's a point really for last week, we saw rates go higher. again catalyst being fitch. you start saying wait, that's competition with stocks. why is the market down so much, two year treasury started the year at 1%, worked its way up to 5, 5 and a quarter.

people start going there, coming out of stocks. it's a balance back and forth with interest rates, with stocks and again, a lot of people don't understand it but that competition you're talking about, t bills and the two year risk free, so-to-speak, that takes money off the table. that continues that way, one concern we v by the way is the federal reserve, we would like to think we're in the eighth or ninth inning of rate hikes. they're going to extra innings. if the numbers stay hot, oil, interest rates, they'll have to raise rates two or three more times this year, i think the expectation is one. that's another reason why i think the vic spiked, recognition that the fed may probably whip. they'll probably whip again in '23 and '24. maria: we'll keep watching that. your morning mover is cheg, it's up in the premarket. shares on the online education company soaring after posting better than expected second quarter sales.

maria: welcome back. millions of americans up and down the eastern seaboard getting hit with a deluge of stormy weather. cheryl casone with all the details. >> at least two people are dead after severe storms rock the east coast. hail and destructive winds ripping through states like west virginia, more than 50 million americans were placed under tornado and thunderstorm watches from tennessee to new jersey. over a million people lost their power yesterday. and then take a look at this, a possible tornado was seen touching down in central new york state. the severe weather forcing airports across the t nation to ground thousands of flights. well, with just over two weeks to go, former vice president mike pence announcing he has qualified for the republican presidential debate. pence reaching the needed 40,000 donor threshold. this makes him the eighth gop candidate to announce they met the rnc's criteria.

both know. maria: i'm all in on that. thank you so much, cheryl. >> we're all in on dusty. maria: thanks, cheryl. republicans are slamming president biden over his response to china and russia bringing 11 ships near the coast of alaska over the last two weeks. during a joint naval operation. this happened last week. the u.s. mobileized four destroyers and surveillance planes to guide the ships away from american territory. this was one of the largest provocations we've seen yet from china. the wall street editorial board writes this the naval patrol is best understood as a warning that u.s. territory is not safe as well as a test of how the u.s. will respond. the world is getting more dangerous and a complacent u.s. political class is not educating the public about the growing threat. joining me right now is fox news senior strategic analyst, chairman of the institute for the study of war, general jack

keane back with us. general, always a pleasure. thanks so much for being with us this morning. >> yeah, delighted to be here, maria. maria: what is your assessment of that naval patrol exercise that russia and china did right near alaska a week ago? >> well, i think it really underscores the seriousness of the strategic relationship between china and russia. it's an informal political, military and economic alliance between two nuclear super powers and their common objective is to reduce the influence of power of the united states in the world. the united states still has the number one military. we've got 384 bases in the united states and around the world and we can project combat power in a way that no other nation can but here's the problem, maria. when we get within 1,000 miles of the china coast, china has a decisive military advantage and

that is the issue here because they're using intimidation and coercion campaign to take over taiwan. russia has already as part of this partnership started a war in europe and president xi is threatening a war in the pacific. so this is a dangerous and certainly formidable relationship that we are facing. we haven't faced anything like this since germany in europe and north africa during world war ii in japan in the pacific during world war ii and our budget doesn't reflect it, maria. the biden budget today is under 3% of gdp. which means it's not even meeting inflation needs. how can we possibly catch up to china which has more platforms in every category than the united states has except submarines if we don't have an adequate defense budget and what message does that send to china when we don't -- when where not

meeting any reasonable objectives to catch up to their advancing military capability. maria: and that advancing military capability as you call it, general, has been building up in plain sight before our very eyes. you've been calling it all along the way. raising the red flag that the chinese navy is bigger than the u.s. navy, that we are out-manned, out-gunned. you've said that so many times. so how is it possible that this is just continuing to happen without the u.s. responding? what should be the proper response here to communist china after a surveillance balloon travels the country for a week, police stations all across america, cyber attacks just as antony blinken is getting ready to go to beijing, they're actually hacking into the commerce department and the state department understanding exactly what his plan is. all of this with no response from the biden administration, no wonder we have this provocation right next to

alaska, next to the u.s. coast. so what should the u.s. be doing right now? >> the concern i have, ever since the spy balloon incident back in february, the administration seems to have shifted policy. i mean, we were advancing our exercise program in the pacific. we've been coordinating with our allies and partners and give them credit for that because they took what the trump team did and strengthened it. but since the spy balloon incident, we seem to become very conciliatory, very appeasing, we seem to be afraid of provoking china in our outreach to them, diplomacy and engagement has become the primary means of dealing with china. the only thing that china truly respects and russia is in the same category, it's not words, it's not rhetoric. it's not feel good meetings. it's steadfastness and resolve and capability that's being

demonstrated and that's the concern that we have. and also i totally agree with the wall street journal piece when they say we've got to come clean with the american people about the seriousness of this threat and why there's danger on the horizon because of the erosion of our military capability by -- compared to them. we have said time and time again if we're involved in a military conflict with china, we would be challenged to win and we indeed could lose and that would be cat stroh figure in terms of the -- the-catastrophic in terms of the united states and the security of the american people. those are harsh realities. the american people are adults. they can handle this. tell them what the problem is and tell them what we're doing about solving it. maria: yeah. great point. instead, we're getting censorship all around. but you know, i mean, let's just look at foreign policy for a moment because most people who are studying this say our

adversaries got the cue to ramp up their provocations after the afghanistan pullout. right? it's been nearly two years since 13 u.s. service members were killed in the biden administration's chaotic withdrawal from afghanistan. now some of those gold star families are speaking out for the first time. they want answers and accountability. watch this. >> when our leaders called this evacuation a success as if there should be celebration, it is like a knife in the heart. >> this commander in chief chose to use them as a pawn so we can meet his september 11th deadline ant get the optics he wanted. >> for the secretary of defense, general austin, the head of the joint chiefs of staff, general milley, to say they're satisfied with the withdrawal of our troops is nothing short of disgusting and ignorant. >> we were told lies, given

incomplete reports, incorrect reports, total disrespect. maria: this is so sad, general. i mean, these young men and women, they went, they were kids. they were teenagers. they went to fight for their country and to serve their country with honor and they lost their lives, 13 servicemen lost their lives because of a botched plan and a weak withdrawal. for what? and then they call it a success. >> yeah, i mean, that's very frustrating. it's heart breaking certainly to listen to that testimony that's being provided there. listen, we've got to pin the rose here. this is president biden's decision. he made this decision to withdraw with a date certain and with no conditions whatsoever over the objections of his entire military chain of command. the director of the central intelligence agency and all the

nations who were participating in afghanistan with us in providing troops, they wanted to stay. not to make the united states feel good because it was in their national interest. that was the recommendation that he received. with arrogance, he believed he was the smartest man in the room and he knew more about afghanistan than anybody else. and he said we're going to withdraw, even though he was told they could go a lot faster than they think. we didn't -- there was no cease fire. there was no peace agreement before the withdrawal. there was no condition that we're going to get the people out who have been working with and make certain only american citizens -- all the american citizens are out. none of those conditions were established. we saw what happened as a result of that. the chaos of a retreat from afghanistan is what we witnessed and you're absolutely right, maria. this is a seminole event that ran around the world and the united states was portrayed with

accuracy as showing weakness and poor judgment and we've been dealing with the reality of increased adversarial aggression ever since that time. maria: yeah. and then the second thing that he does, joe biden, is that he takes sanctions off putin's pipeline. why take sanctions off the nord stream pipeline? that was the putin pipeline went into europe. that was another question that people had, why are we doing this? i mean, the policy decisions have ramped up our adversaries. >> no, there's no doubt about that. i mean, the aggression you've seen from china and certainly, listen -- maria: and russia. >> let's face it, the fact that putin went into ukraine, i don't believe that event happens whatsoever for two things, one, in march of '21, 60 days into the biden administration, putin

kamala harris' former staffers, defending her poor ratings which of course recently hit an all time record low. a new nbc poll reveals 49% of voters have a negative view of the vice president compared to 32% who say they have a positive view. it doesn't stop there. even independents are not crazy about kamala harris, cnn poll finds 57% disapprove of the vice president's job performance. lee, your reaction? >> well, there's a reason why republicans are trying to focus on kamala harris as the next president. it's because she is the most unpopular vice president in recorded history according to the nbc news poll where she has a net 17 negative of reaction here. when you try to cover it up by saying that the reason is that she is a black woman or a history maker, the reason why americans have a low approval rating, the more they get to know her, the less impressed they are. all of the things she's been responsible for, immigration,

she's the immigration czar, she's the a.i. czar, she's all of these different things where people actually are having really negative feedback. hair saying immigration -- they're saying immigration is one of the biggest problems we're facing. people are very afraid of a.i. she's done nothing to allay our concerns. sheaf is not doing a good job with what she is put in charge of. it has nothing to do with the exact that people don't understand what vice presidents do. she hasn't made the case for the american people and hasn't done what she promised to do. maria: greg, what do you think? >> i think lee said it best. this is really about action. it's about policy. on the flip side, vice president harris has an excellent opportunity for herself. you look at the president, clearly he has slowed down. the country is looking for ideas. they're looking for action. and if you look right at the border, clear cut-and-dry there, a clear mandate to go down there and show the american people that you're taking action with the issues that mean most to

them. this is not about the color of anyone's skin. this is about policy. it's about results. it's about the state of the economy and like i said, the poll numbers right now are not terribly good but the good thing about poll numbers is you personally have an opportunity to change that and i think the vice president does have an opportunity here to change that going forward but she's going to need to change some of the things she's been doing for the last kim of years. maria: she just always seems unprepared. >> i mean, a.i., it's two letters, it means -- i mean, she is so co condescending. she is so unprepared. it seems like she talks down to people. that doesn't resonate. nine out of 10 democratic women say one of the most important issues to them they're going to vote on is abortion. she could be talking about women's issues that g galvanizes
